Up until the present, the legislature of all of the EU countries, including the Czech Republic, has lacked an adequate form of legal framework to facilitate the joint establishment and operation of large research facilities of European interest, such as ELI.  This topic became the subject of a key initiative in July 2008, when a new Council Regulation for a legal framework for a European research infrastructure (ERI) was proposed by the European Commission. The EU Council reached political consensus on establishing a Community legal framework for a European Research Infrastructure Consortium (ERIC) on 29 May 2009, and on 28 August 2009 the Council Regulation no 723/2009 entered into force.

Continued discussion during the Preparatory Phase of the ELI Project have identified ERIC as the most appropriate legal format to shield establishing and operating a large international research infrastructure

Council Regulation (EC) No 723/2009 thoroughly defines the characteristics of this new legal framework, particularly addressing the following regulations:

• An ERIC is a legal entity based on EU law designed for the purpose of establishing and operating a research infrastructure on a non-profit basis. An ERIC is a legal entity recognized in all EU Member States;
• ERIC has the most extensive legal capacity and has full competence to carry out legal actions;
• An ERIC must at all times have at least three Member States as members;
• Any Member State (or representative bodies thereof), may be represented by its scientific institutions, as regards the exercise of specified activities, rights and the discharge of specified obligations as a member of the ERIC. The Member States, as members of the ERI Consortium, must assume a full legal responsibility associated with their ERIC membership;
• An ERIC is a legal entity based on EU law (Article 171 of the EC Treaty), which is reserved for the purpose of establishing and operating a research infrastructure;
• The setting-up and internal functioning of an ERIC shall take place following the decision made by the European Commission concerning its establishment (Article 6 Council Resolution (EC) no 723/2009)

Implementation of ELI will consist in building three laser facilities that will be consolidated under the ELI project and located in three EU Member States prepared to commit their structural funds, own financial contributions and resources to finance their share of the ELI Project.

The member base of the ELI-ERIC Consortium will be made up of the representatives of the integrated proposal of the ELI Project, the founding countries—the Czech Republic, Hungary, and Romania—and the primary partners of the ELI Preparatory Phase (ELI-PP)—Germany, Great Britain, France, and other countries. The first motion for establishing the ELI-ERIC Consortium is forecasted for the second half of 2010.

In an effort to ensure a smooth and effective operation of the Infrastructure on the national level, each facility that becomes a part of the ELI-ERIC will have its own local implementation team. The manager of the Czech Team will therefore bear the full responsibility for successful completion of the scientific program of the ELI Facility in the Czech Republic.

The ELI-ERIC Statute Text, which is presently undergoing completion, will contain regulations warranting each Member State contributing its structural funds a full control and responsibility as mandated for meeting its obligations and indicators established for the various individual structural funds projects.

Do dnešní doby neexistoval jak v našem právním systému, tak v systémech ostatních evropských zemí žádný vhodný právní rámec pro vybudování a provoz takového velkého mezinárodního zařízení, jakým bude ELI. Toto téma se stalo jednou z klíčových iniciativ Evropské komise, která v červenci 2008 předložila návrh nařízení Rady EU o právním rámci pro evropské výzkumné infrastruktury. Rada EU dosáhla dne 29. května 2009 politické dohody o návrhu nařízení a 28. srpna 2009 publikovala Nařízení Rady (ES) č. 723/2009, které stanoví nový právní rámec ERIC – European Research Infrastructure Consortium.

V průběhu dosavadní diskuse v rámci přípravné fáze projektu se došlo k závěru, že nejvhodnější budoucí právní forma subjektu zastřešujícího vybudování a provozování mezinárodní infrastruktury je právě ERIC.

Nařízení Rady (ES) č. 723/2009 definuje charakteristiky této nové právní formy a to především:

• ELI-ERIC je právní formou určenou k vytvoření a provozu výzkumné infrastruktury na neekonomickém základě;
• ELI-ERIC má plnou právní způsobilost a způsobilost k právním úkonům;
• Jeho členy musí být nejméně tři členské státy EU;
• Státy (resp. je reprezentující orgány) jsou formálně členy konsorcia ERIC, přičemž mohou pověřit vědecké instituce k tomu, aby je zastupovaly při výkonu činností souvisejících s infrastrukturou, což však nic nemění na tom, že právní odpovědnost související s členstvím zůstává na státu jako členu konsorcia;
• ELI-ERIC je právní subjektem zřízeným podle komunitárního práva (Článek 171 Smlouvy o Evropském společenství);
• Konsorcium bude zřízeno po rozhodnutí Evropské Komise o jeho zřízení (dle čl. 6 Nařízení Rady (ES) č. 723/2009)

V kontextu zamýšleného projektu ELI by měla technická infrastruktura zahrnovat tři laserová centra umístěná ve třech členských státech EU, které mají v plánu financovat svoji část projektu z prostředků strukturálních fondů, vlastního příspěvku a z vlastních zdrojů.

Zakládajícími členy konsorcia ELI-ERIC by se měli stát zástupci integrovaného návrhu, což jsou Česká republika, Maďarsko a Rumunsko, a hlavní partneři přípravné fáze projektu ELI, mezi které patří Německo, Velká Británie a Francie a další země. Předpokládá se, že o ustanovení ELI-ERIC bude možné požádat v průběhu druhé poloviny roku 2010.

V zájmu zajištění hladkého a efektivního řízení infrastruktury na národní úrovni bude mít každé zařízení, které tvoří ELI-ERIC, vlastní místní realizační tým. Manažer českého týmu tak bude zodpovídat za úspěšné plnění vědeckého programu centra ELI v České republice.

Připravovaný návrh stanov ELI-ERIC obsahuje ustanovení zajišťující, že každému z členských států, který přispívá z prostředků strukturálních fondů, zůstává zachována plná kontrola a odpovědnost v souvislosti s výkonem povinností a plněním kriterií (indikátorů) stanovených pro jednotlivé projekty ze strukturálních fondů.
